1. Acceptance of Terms
By accessing or using VDrape ("the Platform"), operated by Visual Vastra Technologies ("we", "us"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Platform.
2. Description of Service
VDrape is an AI-powered virtual garment try-on platform that allows users to visualize how clothing may look on them. The Platform:
- Uses artificial intelligence (Google Gemini) to generate synthetic try-on images.
- Produces AI-generated previews that are not real photographs.
- Does not guarantee that garments will look identical to AI previews in real life — colour, fit, drape, and texture may vary.
3. Eligibility
- You must be at least 18 years old to create an account.
- If you are using the try-on feature for a person under 18, you represent that you are their parent or legal guardian and consent to their photo being processed.
- By using the Platform, you represent that you have the legal capacity to enter into these Terms.
4. Photo Upload & Consent
By uploading a photo to VDrape, you:
- Consent to the photo being processed by our AI system to generate a virtual try-on image.
- Consent to the photo being transmitted to Google Gemini API for AI processing.
- Confirm that you have the right to upload this photo — it is either your own photo, or you have explicit permission from the person depicted.
- Confirm that if the photo is of a minor (under 18), you are the parent/legal guardian.
- Understand that you may withdraw consent and request deletion at any time.
5. AI-Generated Content
- All try-on results are AI-generated synthetic images, not real photographs.
- Results may not accurately represent actual garment appearance, colour, size, or fit.
- We do not warrant the accuracy, quality, or reliability of AI-generated content.
- AI-generated images are marked as such and must not be presented as real photographs.
6. Prohibited Uses
You must NOT use VDrape to:
- Upload photos of any person without their explicit consent.
- Generate try-on images for the purpose of impersonation, fraud, defamation, or harassment.
- Create deepfakes or misleading synthetic content that could deceive others.
- Use generated images in any manner that violates the IT Act 2000 (including Sections 66D, 66E), or any other applicable law.
- Upload obscene, illegal, or harmful content.
- Circumvent rate limits, usage restrictions, or security measures.
- Reverse-engineer, scrape, or extract data from the Platform.
Violation of these prohibitions may result in account termination and legal action.
7. Intellectual Property
- You retain ownership of photos you upload.
- AI-generated try-on images are provided for your personal or business use (garment visualization) only.
- The VDrape platform, branding, and technology are the intellectual property of Visual Vastra Technologies.
- Product images and garment designs remain the property of their respective brand owners (tenants).
8. Disclaimer of Warranties
The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee that AI-generated images will accurately represent how garments look in real life. Actual product colour, fit, fabric texture, and appearance may differ from AI previews.
9. Limitation of Liability
To the maximum extent permitted by law, Visual Vastra Technologies shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount paid by you to us in the 12 months preceding the claim.
10. Data Protection
We process your data in accordance with our Privacy Policy, the DPDPA 2023, IT Act 2000, and applicable regulations. You may exercise your data protection rights as described in our Privacy Policy.
11. Tenant Responsibilities (B2B)
If you are a business tenant using VDrape for your customers:
- You must inform your customers that AI-powered virtual try-on is being used.
- You must obtain appropriate consent from your customers before their photos are processed.
- You must not use VDrape to create misleading product representations.
- You are responsible for the accuracy of product images and descriptions you upload.
12. Termination
We may suspend or terminate your account for violation of these Terms. Upon termination, your data will be deleted in accordance with our retention policy. You may delete your account at any time via Settings.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.
14. Grievance Redressal
For complaints or grievances, contact our Grievance Officer at support@vdrape.com. Complaints will be acknowledged within 48 hours and resolved within 30 days.
15. Changes
We may modify these Terms at any time. Material changes will be notified via email or in-app notice at least 30 days before taking effect.
